This Acceptable Use Policy ("AUP") sets out the acceptable and prohibited uses of the Internet access and network services provided by Iceblue Global Ltd. ("Iceblue Global Ltd.," "Vendor," "we," or "us"). This AUP is incorporated into and supplements the applicable Iceblue Global Ltd. Service Agreement. It applies to all customers ("Subscribers") and their end users ("Users") who access or use Iceblue Global Ltd.'s services ("Services").
Iceblue Global Ltd. respects the Internet as a forum for free and open discussion and the exchange of information. At the same time, the integrity and security of our network must be protected, and Subscribers must use the Services responsibly and in accordance with applicable laws and regulations.
1. Definitions
- Subscriber: Any individual or entity who has entered into a service agreement with Iceblue Global Ltd.
- User: Any individual or entity who accesses or uses the Services, whether directly as a Subscriber or indirectly through a Subscriber.
- Services: Any Internet access, hosting, connectivity, or related network services provided by Iceblue Global Ltd.
- Content: Any material transmitted, received, stored, or otherwise made available via the Services.
2. Subscriber Responsibilities
- Subscribers are solely responsible for the Content they and their Users create, transmit, access, or make available using the Services.
- Iceblue Global Ltd. does not monitor, review, edit, or censor Content created or transmitted by Subscribers or Users. Subscribers must exercise appropriate judgment when relying on or disseminating information obtained via the Internet, which may be inaccurate, offensive, or illegal.
- Subscribers are legally liable for any Content that infringes copyrights, trademarks, trade secrets, or other intellectual property rights; defames others; or violates applicable law.
- Subscribers must ensure that their own customers and end users comply with this AUP. Violations by a Subscriber's customer or user will be treated as a violation by the Subscriber.
3. Prohibited Activities
Spamming
- Sending unsolicited commercial or bulk messages ("spam")
- Maintaining an open SMTP relay or otherwise facilitating spam
- Using the Services to host, promote, or enable spam-related services
Intellectual Property Violations
- Infringing or misappropriating intellectual property rights, including copyrights, trademarks, patents, and trade secrets
- Violating privacy, publicity, or other personal rights
- Iceblue Global Ltd. will remove or block access to infringing material upon receiving a valid notice and may terminate repeat infringers
Obscene, Illegal, or Harmful Content
- Creating, transmitting, or making available child sexual abuse material or obscene content
- Engaging in activity that violates criminal laws
- Iceblue Global Ltd. will report illegal activity to law enforcement where required
Defamatory, Abusive, or Harassing Language
- Transmitting or posting defamatory, threatening, harassing, or abusive language or materials
Forgery or Misrepresentation
- Forging or altering message headers or other identifiers to disguise the origin of transmissions
Unauthorized Access or Hacking
- Accessing systems, networks, or accounts without authorization
- Attempting to circumvent security or authentication measures (e.g., port scans, stealth scans, credential theft)
Malicious Software and Network Disruption
- Creating, distributing, or transmitting viruses, worms, Trojan horses, or other malicious code
- Launching or facilitating denial-of-service (DoS/DDoS) attacks, flooding, or mailbombing
- Engaging in activities that disrupt or degrade network performance or availability
Other Prohibited Activities
- Facilitating AUP Violations: Advertising, transmitting, or providing software, services, or tools designed to violate this AUP (e.g., spam tools, DDoS services, piracy tools)
- Export Control Violations: Exporting encryption software or other controlled technologies in violation of applicable export laws or regulations
- Usenet and Newsgroups: Posting to newsgroups or forums where Iceblue Global Ltd. has actual knowledge that the content violates this AUP
- Illegal Activities: Engaging in or promoting fraud, Ponzi schemes, pyramid schemes, credit card fraud, identity theft, or software piracy
- Harmful Activities: Engaging in any lawful or unlawful activity that Iceblue Global Ltd. determines to be harmful to its network, operations, reputation, goodwill, or customer relationships
4. Enforcement and Monitoring
Monitoring Policy
Iceblue Global Ltd. does not proactively monitor Subscriber communications. However, it may monitor its network as necessary to ensure operational stability and compliance with the law.
Vendor Actions
Upon becoming aware of a violation of this AUP, Iceblue Global Ltd. may, at its sole discretion:
- Suspend, restrict, or terminate access to the Services
- Remove or block access to Content
- Cooperate with law enforcement or regulatory authorities
- Take any other legal or technical action deemed necessary
Subscribers Providing Services to Others
Subscribers who provide Internet services to their customers must ensure compliance with this AUP. Iceblue Global Ltd. may act directly against a customer of a Subscriber or against the Subscriber itself. Subscribers are expected to cooperate with Iceblue Global Ltd. in addressing violations.
Legal Disclosures
Iceblue Global Ltd. may disclose Subscriber or User information to comply with court orders, subpoenas, warrants, regulatory requirements, or other legal processes.
Privacy of Communications
Iceblue Global Ltd. will not intentionally monitor private electronic communications unless required by law or where public safety is at risk.
5. Indemnification and Liability
Subscribers agree to indemnify, defend, and hold harmless Iceblue Global Ltd., its affiliates, officers, employees, and agents from and against any and all claims, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
- A Subscriber or User's use of the Services
- Any violation of this AUP or the Service Agreement
- Any violation of applicable law
Iceblue Global Ltd. assumes no liability for any Content transmitted over its network or for any consequences of AUP violations by Subscribers or Users.
6. Modifications to this AUP
Iceblue Global Ltd. may modify this AUP from time to time by posting an updated version on its website. Unless otherwise stated, changes become effective 30 days after posting. Continued use of the Services constitutes acceptance of the updated AUP.
7. Governing Law
This AUP shall be governed by and construed in accordance with the laws applicable to the applicable Service contract under which Iceblue Global Ltd. provides its Services, without regard to conflict of law principles.
